Terms and Conditions
These Terms and Conditions (Terms) govern your use of the Topp Performance website and app (the Service). By creating an account, subscribing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. About us
The Service is operated by TOPP SYSTEMS LTD trading as Topp Performance (we, us, our).

2. Key definitions
- Account: your registered user profile.
- Content: training plans, workouts, guidance, educational materials, and other content made available in the Service.
- Subscription: a paid plan billed on a recurring basis.
- Third Party Service: services you can connect to or we rely on (for example Garmin, Strava, TrainingPeaks, Intervals.icu, payment processors).
3. Eligibility and account rules
3.1 Under 16s. The Service is not intended for, and must not be used by, anyone under 16 years old. We do not permit access for under 16s.
3.2 Accurate information. You must provide accurate account information and keep it up to date, including information relevant to safe training where requested.
3.3 Account security. You are responsible for keeping your login details secure and for all activity on your Account. Tell us promptly if you suspect unauthorised use.
3.4 Personal use. Your Account is personal unless we provide a coach or team product that allows multi-athlete management.
4. What the Service is and is not
4.1 The Service provides tools and Content that may include training planning, performance analytics, readiness insights, and nutrition or fuelling guidance.
4.2 Coaching may or may not be included. Depending on the plan you purchase, you may receive software-only tools or coach-supported services. Your checkout page or plan description will state what is included.
4.3 Not medical advice. The Service is not a medical service and does not provide medical advice, diagnosis, or treatment.
5. Health, safety and nutrition warnings
5.1 You use the Service at your own risk. Cycling and exercise involve inherent risks, including serious injury or death. You are responsible for deciding whether to train and how you execute any session.
5.2 Medical clearance. Seek medical advice before using the Service if you have, or suspect you have, a medical condition that may be affected by exercise or nutrition changes.
5.3 Nutrition guidance limitations. Training and nutrition plans are personalised based on the data you input, but they do not take account of all individual medical conditions (for example diabetes or other metabolic conditions). You must not override or disregard advice from your physician or other qualified healthcare professional.
5.4 Stop if warning signs occur. Stop exercising and seek medical help if you experience chest pain, dizziness, fainting, unusual shortness of breath, palpitations, severe pain, or any other concerning symptoms.
5.5 No unsafe use. Do not use the Service in a way that distracts you while riding, driving, or operating equipment.
5.6 Events and environments. You are responsible for complying with laws, event rules, and safety requirements where you train.
6. Your responsibilities
You agree to:
- Provide truthful training history and relevant information about injuries, illnesses, and constraints that affect training safety.
- Use safe progression and recovery practices and use appropriate equipment in safe condition.
- Provide timely and accurate feedback where requested (for example RPE, notes, and readiness inputs).
If coaching is included, you understand that outcomes and plan quality depend on the data and feedback you provide. We may pause, reduce, or modify training recommendations if we reasonably believe continuing as planned may create an unacceptable safety risk.
7. Subscriptions, billing and cancellation
7.1 Pricing and renewal. Subscription pricing, billing frequency, and included features are shown at checkout. Subscriptions renew automatically unless you cancel before renewal.
7.2 How to cancel (standard web subscription). If you subscribed on our website, you can cancel at any time:
- In-app: Log in, go to Account (or Settings) then Billing or Subscription, and select Cancel subscription. Follow the on-screen steps. We will display the date your access ends.
- By email: Email support@topp-cycling.com from the email address on your Account with the subject line "Cancel subscription". Include your full name and the email linked to your Account. We will confirm cancellation by email.
7.3 When cancellation takes effect. Unless stated otherwise at checkout, cancellation takes effect at the end of your current billing period. You will retain access to paid features until that date.
7.4 Third-party purchases. If you subscribed through a third party (for example Apple App Store or Google Play), you must cancel through that third party and their rules apply.
7.5 Failed payments. If payment fails, we may retry and may suspend access to paid features until payment is successful.
7.6 Price changes. If we change prices, we will provide notice before the new price applies and you can cancel before renewal.
8. Trials, discounts and promotions
8.1 Trials and discounted periods apply only for the stated duration. Unless you cancel before the trial or discount ends, billing continues at the standard rate.
8.2 Promotion codes may have eligibility restrictions, usage limits, and expiry dates. We may refuse codes where misuse or fraud is suspected.
9. Refunds and consumer rights
9.1 If you are a consumer, you have statutory rights under UK law for digital content and services. These Terms do not remove those rights.
9.2 Refund policy. Unless required by law, fees are non-refundable once a billing period has started. Any goodwill guarantee we offer (if any) will be stated at checkout and in our refund policy.
10. Third Party Services and data accuracy
10.1 The Service may connect to Third Party Services. If you connect them, you authorise us to access and process the data you permit under those integrations.
10.2 Third Party Services may change, malfunction, or be unavailable. We are not responsible for outages, API changes, sync delays, or inaccuracies caused by Third Party Services.
10.3 Training and nutrition metrics are estimates. Outputs such as VO2 estimates, readiness, energy expenditure, carbohydrate burn, and similar metrics may be directionally useful but are not guaranteed accurate and should not be treated as clinical measurements.
11. Acceptable use
You must not:
- Use the Service unlawfully or dangerously.
- Harass, abuse, threaten, or impersonate others.
- Attempt unauthorised access to accounts, systems, or data.
- Upload malicious code or interfere with the Service.
- Scrape, crawl, reverse engineer, decompile, or attempt to extract source code except where permitted by law.
- Use the Service to build a competing product or misuse our Content.
We may suspend or terminate Accounts that breach these rules.
12. User content and licences
12.1 You retain ownership of content you upload (for example notes, files, messages).
12.2 You grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, and display your content solely to provide, maintain, and improve the Service and to meet legal obligations.
12.3 If you provide feedback or suggestions, you grant us the right to use them without restriction and without compensation.
13. Intellectual property
The Service, Content (excluding your uploads), branding, software, and related intellectual property belong to us or our licensors. We grant you a limited, personal, non-transferable, revocable licence to use the Service for your personal training purposes during your active Subscription or authorised access period.
14. Service availability and changes
We aim to keep the Service available but do not guarantee uninterrupted access. We may update or modify the Service for security, performance, feature improvements, legal compliance, or operational needs. If a change materially reduces paid functionality, we will act reasonably and in line with applicable consumer law.
We may update these Terms. If changes are material, we will provide notice and indicate the effective date.
15. Privacy and data protection
Our Privacy Policy explains how we collect and use personal data, including fitness and health-related data.
16. Liability
16.1 Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law (including liability for death or personal injury caused by negligence, or for fraud).
16.2 Subject to 16.1, you are responsible for your training and nutrition decisions and execution. We are not liable for injuries, illness, accidents, or damages arising from your participation in sport or from how you apply Content or recommendations.
16.3 Subject to 16.1 and mandatory consumer protections, our total liability to you for claims connected to the Service is limited to the total fees you paid us for the Service in the 12 months before the event giving rise to the claim.
16.4 Subject to applicable law, we are not liable for indirect or consequential losses, loss of profits, loss of business, or loss of goodwill.
17. Suspension and termination
You can stop using the Service at any time and cancel your Subscription as described in section 7. We may suspend or terminate your Account if you materially breach these Terms, if we reasonably believe your use creates a safety or security risk, or if required by law.
18. Communications
18.1 Service messages. We may send emails and in-app messages that are necessary to provide the Service and manage our contract with you, including verification, security alerts, plan and onboarding messages, support responses, billing notices, and important changes to the Service or these Terms. You cannot opt out of these messages while you maintain an Account.
18.2 Marketing messages. If you opt in, we may send marketing emails about Topp Performance, including product updates, training content, and offers. You can opt out at any time using the unsubscribe link in any marketing email.
18.3 We handle your personal data, including your email address and marketing preferences, in accordance with our Privacy Policy.
19. Governing law
These Terms are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction, subject to any mandatory consumer protections that apply to you.
